“I’ve been before Judge Lopez and dealt with him for five years now. I find him to be a very fair judge who’s very concerned about a fair and equitable process where there’s a lot of disclosure and everybody feels comfortable that they know whatever is going on in in an auction or in any part of the court process.”

6. SOUNDBITE (English) Jeff Anapolsky, Professor, University of Houston Law Center:
“Well, maybe it’s a little bit surprising here is that Judge Lopez listen to complaining, whining, if you will, of a disgruntled backup bidder that didn’t win. That’s not one of his constituents. Right. The bidders don’t have a say in bankruptcy court. They just get the bid. And this is not the first time that an unsuccessful bidder is very disgruntled and complains. But so what? Shoulda bid more.”

“Here’s an example where unfortunately the trustee didn’t have a witness to put up to say, Hey, I’m a qualified investment banker and I did the right process and I’ll stand up for the process as being the best process that we could have done.”

10. SOUNDBITE (English) Jeff Anapolsky, Professor, University of Houston Law Center:
“The trustee has wide latitude here. He could certainly ask The Onion to increase its bid. He could certainly go back and run another auction. Right. Which wouldn’t necessarily be that hard. He could just have the two final parties come to his office and say, we’re just going to go back and forth until we get the highest one.”

“So that’s up to Mr. Murray now and the trustee to go do something to make everybody feel like everybody had their say and understand the transparency of the process.”

STORYLINE:
The Onion’s rejected purchase of Infowars in an auction bid supported by families of the Sandy Hook Elementary shooting dealt them a new setback Wednesday and clouded the future of Alex Jones’ conspiracy theory platform, which is now poised to remain in his control for at least the near future.
What’s next for Infowars and Sandy Hook families’ long-sought efforts to hold Jones accountable over calling one of the deadliest school shootings in U.S. history a hoax was unclear, after a federal judge in Houston late Tuesday rejected The Onion’s winning bid for the site.
The families, meanwhile, were preparing the mark the 12th anniversary of the Dec. 14 shooting.
