Appeals court upholds TikTok ban or sale in the US, AP Explains

"So a federal appeals court in D.C. today denied a petition by TikTok and its parent company, ByteDance, to overturn a law that would have required ByteDance to sell TikTok or face a ban in the United States. For a number of years, federal officials and lawmakers from both parties have come out, and they’ve said that they’re concerned that the Chinese government could potentially pressure ByteDance, which is based in China, to hand over U.S. user data or compel it in some way to put information on the app that is beneficial to the Beijing’s interest or maybe even suppress information that Beijing would want suppressed, but the Justice Department hasn’t really come out and said that this has actually happened in the U.S.. So TikTok and ByteDance are expected to appeal this case to the Supreme Court, but we don’t know if the Supreme Court is going to take up the case. President-elect Donald Trump, who in the past tried to ban TikTok, has also come out and said that now he’s against a TikTok ban and he’s going to try to save the app, but we really don’t know what he’s going to do or how he’s going to try to deliver on that promise. The company said this morning that unless this law is stopped, that millions of American users who use TikTok are going to have their voices silenced by January 19th. That is the deadline for when ByteDance must sell TikTok. Although the law also gives the president discretion to give a three months extension if some sort of a sale is in progress by that date."

STORYLINE:
A federal appeals court panel on Friday unanimously upheld a law that could lead to a ban on TikTok in a few short months, handing a resounding defeat to the popular social media platform as it fights for its survival in the U.S.

The U.S. Court of Appeals for the District of Columbia Circuit denied TikTok’s petition to overturn the law — which requires TikTok to break ties with its China-based parent company ByteDance or be banned by mid-January — and rebuffed the company’s challenge of the statute, which it argued had ran afoul of the First Amendment.

TikTok and ByteDance — another plaintiff in the lawsuit — are expected to appeal to the Supreme Court, though its unclear whether the court will take up the case.
