2. Various of climate activists crying and hugging after ruling
3. Donald Pols, the director of environmental charity Milieudefensie, walking out of court building
4. SOUNDBITE (Dutch) Donald Pols, director of Milieudefensie (Friends of the Earth):
"This really touches me. This should have been the moment of a real breakthrough in the fight against dangerous climate change. That didn’t happen today, but the fight against dangerous climate change is a marathon, not a sprint, and the race has only just begun."
5. Pols speaking
6. SOUNDBITE (English) Donald Pols, director of Milieudefensie (Friends of the Earth):
"It’s too early to announce new steps, we are going to take the time to read the court judgement. But it’s clear in the summary the judge stated that more than 800 oil and gas projects that are planned by Shell, that they are contradictory to the responsibility of Shell to reduce its CO2 emissions in accordance with international climate agreements and contributes to human rights violations."
7. Various of Milieudefensie banner in front of court building, reading (Dutch) "We cannot wait"
8. SOUNDBITE (English) Neele Boelens, climate activist from Friends of the Earth:
"To be honest I was just really disappointed, I was almost crying. I was in there in the court and we were just like… at first it looked really good for us, but then it just went down hill. There are some points of light, I guess: the court acknowledged that Shell actually has to reduce their emissions, however we cannot go further with this court case like this. I’m just really disappointed and I feel like it’s a setback for climate action and for all the reductions that are needed in this world at this moment since the climate crisis is now."
9. Activists standing in front of court building
10. SOUNDBITE (English) Isja Mannens, climate activist from Friends of the Earth:
"So it’s very disappointing obviously and it also kind of shows that maybe this isn’t the right way to force Shell’s hand in this matter. But yeah, obviously, we’re not done with Shell. We’re still going to campaign. We’re still going to fight and there’s going to be lots of activism still and, if this is isn’t the way, there will be another way to make them reduce their emissions, i think. But obviously, I’m disappointed."

STORYLINE:
A Dutch appeals court on Tuesday overturned a landmark ruling that ordered energy company Shell to cut its carbon emissions by net 45% by 2030 compared to 2019 levels.

The decision was a defeat for the Dutch arm of Milieudefensie (Friends of the Earth) and other environmental groups, which hailed the original 2021 ruling as a victory for the climate.

Donald Pols, the director of Milieudefensie, was disappointed in the ruling but vowed to continue fighting climate change.

"This should have been the moment of a real breakthrough in the fight against dangerous climate change. That didn’t happen today, but the fight against dangerous climate change is a marathon, not a sprint, and the race has only just begun," he said outside the court building.

The ruling upholding Shell’s appeal came as a 12-day U.N. climate conference was entering its second day in Azerbaijan.

Tuesday’s civil ruling can be appealed to the Dutch Supreme Court.
