STORYLINE:
A legal fight over Elon Musk’s $1 million-a-day voter sweepstakes is back in state court Monday in Pennsylvania after a federal judge said Friday he does not have jurisdiction.

The ruling was a loss for the world’s richest man and his political action committee.

Before the hearing Monday, Chris Gober, America PAC attorney, spoke to reporters outside the courtroom claiming Democratic District Attorney Larry Krasner is trying to "silence Elon Musk for supporting Donald Trump."

"Let me be clear about one thing: No district attorney, no prosecutor, I don’t care how powerful they are, can take away the First Amendment freedoms that are the bedrock of this nation, "Gober said. "We don’t back down from bullies. We don’t allow our rights to be trampled upon by partizan agendas masquerading as legal arguments. In the end, truth, truth will not be bullied and neither will my client."

Musk’s giveaways aim to boost Donald Trump’s presidential campaign through Election Day. Krasner calls the America PAC sweepstakes an illegal lottery under state law.

Experts on election law question whether it violates federal law against vote-buying. The case now returns to Judge Angelo Foglietta, who held a brief hearing Thursday.
