2. SOUNDBITE (English) Donte Mills, Attorney representing Jordan Neely’s family:
“We’re here for jury selection today. I think this is going to be and it is a very simple case that’s easy for the jury to deliberate on. The facts of the case is this: Someone got on the train and was screaming, and someone choked that person to death. Those things will never balance out. And there’s no justification that can make those things balance out.”

3. SOUNDBITE (English) Donte Mills, Attorney representing Jordan Neely’s family:
“Andre Zachery, Mr. Jordan’s father, when you ask him how he feels, he feels hurt. But we’re here. The trial’s beginning, and we’re hoping we can get some justice.”

4. SOUNDBITE (English) Steven Raiser, Lawyer representing Daniel Penny:
“This is a very important part of the trial and we’re we’re happy to see that there’s progress to getting to the truth in this case. We feel that the truth is only going to come out through this trial. There’s a lot of evidence that people aren’t aware of. There’s a lot of assumptions that have been made that are going to be dispelled once we have all the evidence. And right now, our job is to make sure that we have a fair and impartial jury that can give Danny a fair trial that he deserves."

5. SOUNDBITE (English) Steven Raiser, Lawyer representing Daniel Penny (on whether Penny will testify in his own trial):
“Well, that’s a question that will remain open until we go through the trial. The D.A. has to present their case first, and we’ll make that determination at that time. We do know that Daniel would be a great witness, and we anticipate that he will, but that will depend on how the trial goes.”

6. SOUNDBITE (English) Thomas Kenniff, Lawyer representing Daniel Penny:
“Jordan Neely’s death is a tragedy. There’s also no dispute about that in this case, by the way. But his conduct and what informed his conduct that day: the paranoid schizophrenia, the psychotic episodes that he had a history of the K-2 use and how that affects someone, particularly how it affects someone and how it intersects with someone who has that sort of psychotic condition. And of course, his behaviors on the subway train. That’s that’s what’s relevant in this case. There’s going to be ample evidence of that. A lot of it’s going to come out, most of it’s going to come out, I think, on the prosecution’s case.”

STORYLINE:
Jury selection has begun in the trial of the U.S. Marine Corps veteran who placed a man in a deadly chokehold on a New York City subway train last year.
Daniel Penny has pleaded not guilty to second-degree manslaughter and criminally negligent homicide in the May 1, 2023, death of Jordan Neely.
Jury selection began Monday in a Manhattan court and could take two weeks. Neely’s death was a flashpoint in the nation’s debate over racial injustice. Some hailed Penny, who is white, as a hero. Others accused him of racist vigilantism against a Black man who was struggling with drug addiction, mental illness and homelessness.
Neely’s father, Andre Zachery, was among those in courtroom audience Monday. The family’s lawyer, Donte Mills, said outside court that Zachery is feeling hurt and seeking justice for his son.
