"The fact that there might be a risk of rejection of validation (of the detentions in the Italian migrants centres in Albania) shows our democracy in good health. In my opinion, the legal measure used by the Government does not protect against this danger. Which (ironically) is a danger that the judges do their job. For the simple reason that not enforcing the ministerial decree that provided for the list of safe countries (migrants from those countries can be processed on a fast track asylum seeking procedure in Albania) is not due to the fact that this list was contained in a secondary law, which is the point on which the Government has insisted a lot. Therefore having transformed the list into a primary rule, into a proper law does not prevent the judge from evaluating and deciding independently.”

“The idea of assessing vulnerabilities such as whether someone is a minor, if they have suffered torture, detention or serious violations of fundamental rights in a context as precarious as the moment of rescue at sea and the disembarkation from a ship, cannot offer any kind of quality. This is especially true because vulnerabilities are not immediately visible and, above all, they are not linked to the citizenship of the country of origin. They are very often the result of traumatic life experiences that people undergo in transit countries and in particular in the countries of departure of the boats, in particular Libya and Tunisia.”

“What the Government says is that it has accepted the content of the European Court of Justice’s verdict, transforming the list of safe countries from a decree to a law and removing the three countries for which there was a geographical exception (Nigeria, Colombia and Cameroon). But the Court of Justice provides exactly for ex officio control by the judge. That is, the obligation for the judge to evaluate individually, ex officio, even without a request from the foreigner, whether the individual country can be considered safe or not for that specific person for the purpose of applying the fast-track border procedure (in the Italian detention centres in Albania).”
