"Simply put, Your Honor, what council is proposing, as far as what the court should do, is prohibited by the rules, is prohibited by the law, is prohibited by the development of case law over the decades and centuries as to what is permitted. Certainly, the Commonwealth, nor anyone wants to try someone who’s been acquitted by the jury of his peers or retry them for the same offense. That’s not what happened. There was no verdict returned by this jury."

STORYLINE:
Prosecutors and defense attorneys in the Karen Read case have returned to court focused on jury deliberations that led to a mistrial on charges that she killed her police officer boyfriend.

Read is accused of ramming into John O’Keefe with her SUV and leaving him for dead in a January 2022 snowstorm.

In a hearing Friday, a defense attorney argued four jurors have said the jury unanimously reached a not guilty verdict on second-degree murder and leaving the scene of a deadly accident and were deadlocked on the remaining manslaughter charge.

Prosecutors meanwhile urged the judge to dismiss the motion.

Judge Beverly Cannone said she would take the matter under advisement.
