According to the procedural rules here, and in most states, a governor needs to sign such a warrant of extradition. "The attorneys and I do not influence correctional health services. We do not influence New York City health and hospitals. All of those decisions are made by those individual organizations without our input, without consulting with us, without asking for our opinions. And there’s been a lot of rumors about him having a cushy room. There’s been false narratives about what that room is like, and we just want to make sure that everybody understands, and so does Mr. Weinstein, that these decisions are made by those organizations."

STORYLINE:
Harvey Weinstein will remain locked up in New York as a court works out whether he should stay in a city jail while he awaits a retrial in a rape case, or be sent back to California to continue serving a prison sentence.
The fallen movie mogul denied consent for the extradition request from California during a brief court hearing Thursday. Weinstein will continue to be held in New York with the next court appearance set for August 7.
Weinstein was released from a city hospital days ago. He showed up for the hearing in a wheelchair and wearing a dark suit.
