“Honourable colleagues, last January 19, Libyan citizen Ossama Anjiem al-Masri, who had recently arrived in Turin after having been in previous days in other European countries, was subjected to the execution of the international arrest warrant for extradition purposes issued the previous day by the International Criminal Court. Upon execution of the order, the offices of the Prosecutor General at the Court of Appeal in Rome and the relevant Department of the Ministry of Justice, as well as the ex officio appointed defense attorney and consular authorities were informed. The Libyan citizen was temporarily detained at the Lorusso and Cotugno prison and then placed at the disposal of the competent judicial authority, namely the Rome Court of Appeal and the aforementioned Attorney General’s Office at the Court of Appeals. The following Jan. 21, the Rome Court of Appeals, as part of its prerogatives to scrutinize measures restricting the freedoms of personal liberty, declared that there was no need to confirm the arrest of the Libyan citizen, which was assessed as formally not regular in that and not provided for by law, ordering his immediate release if not detained for another cause.”
