“Well, of course, a lot of the U.S. tech companies have their headquarters in Ireland because they have been able to get sort of sweetheart tax deals there, so they don’t want to rock the boat, the Irish government and for them it’s beneficial because they get a lot of skilled workers moving there, they get a lot of jobs for skilled workers in Ireland. So, from their point of view, it’s some lost taxes, but they get so much else out of it.”

“It definitely tells them that they should be on watch, that the European Commission, which usually hasn’t that large of a say in tax matters, has some tools that they can use. And of course, a lot of these tax cases, for instance, against Amazon and Fiat and Starbucks, the Commission had lost previously, but this was the big one, it was the largest fine by a long mile. So the Commission winning this is really saying that this is something that can happen to them as well.”

STORYLINE:
A policy analyst said on Tuesday the European Union’s legal win over Apple "was the big one," after the EU’s top court on Tuesday ruled the tech giant to repay 13 billion euros in back taxes to Ireland.

The ruling sends a message to other tech companies, Varg Folkman, a policy analyst at the European Policy Centre said.

“It definitely tells them that they should be on watch, that the European Commission, which usually hasn’t that large of a say in tax matters, has some tools that they can use," he said.

The European Court of Justice overruled a lower court’s earlier decision in the case, saying it “confirms the European Commission’s 2016 decision: Ireland granted Apple unlawful aid which Ireland is required to recover.”

The European Commission, the bloc’s executive branch, had accused Apple of striking an illegal tax deal with Irish authorities so that it could pay extremely low rates.

The European Union’s General Court disagreed with that in its 2020 ruling, which has now been overturned.

"We are disappointed with today’s decision as previously the General Court reviewed the facts and categorically annulled this case,” Apple said in a statement.

“There has never been a special deal," the company said.
