She learned that putting it in a sandwich where Eric Richins could take a bite, feel the effects, set the sandwich down, was not the proper way to administer a fatal dose of fentanyl. Instead, she administered it with a lemon shot where Eric Richards would throw it back all at once."

"When the prosecution talked about her saying, ‘go take a nap’ and how that was chilling, he pulled that completely out of context of the rest of what she said in that text. ‘Would you like me to come home? Jesus. Is it that bad?’ You know, at one point later in the day talks about ‘I wish you were here,’ And she’s like, ‘I would cuddle you.’ So that is very misleading to pull that statement out."

"There’s no evidence he ever took a pill from her. There’s no evidence that she ever. if she put fentanyl in his egg sandwich at 9:30 and he ate it, he would not be okay for two more hours. He would not. And there’s zero evidence, there’s not one piece of evidence from Eric himself that he ever took anything from Kouri that day, that he felt bad up until 11:33 is the first time he feels bad."

"These facts, taken together, would support issuance of a search warrant to investigate whether Miss Richins had attempted to cause the death of her husband. They would support issuance of an arrest warrant for her arrest on attempted murder, and they are sufficient to support bind over under the probable cause standard, for attempted aggravated murder on February 14th, 2022."
9. Judge recesses court
STORYLINE:
A Utah mother of three who published a children’s book about grief after her husband’s death and was later accused of fatally poisoning him will stand trial.
Utah state Judge Richard Mrazik ruled on the second day of Kouri Richins’ preliminary hearing that prosecutors had presented enough evidence against her to proceed with a jury trial.
She faces a slew of felony charges for allegedly killing her husband with a lethal dose of fentanyl in March 2022 at their home in a small mountain town near Park City.
Prosecutors say Kouri Richins slipped five times the lethal dose of the synthetic opioid into a cocktail that Eric Richins drank.
Kouri Richins appeared stoic as the judge delivered the news that a jury would decide her fate.
She has been adamant in maintaining she is innocent and entered pleas of “not guilty” to all 11 counts on Tuesday.
The second day of her preliminary hearing centered around an additional attempted murder charge filed earlier this year that accused her of slipping fentanyl into her husband’s sandwich on Valentine’s Day 2022, causing a severe but nonfatal reaction.
Summit County Prosecutor Brad Bloodworth defended the charge by describing how he thinks Kouri Richins learned lessons during the first unsuccessful attempt on her husband’s life that helped her carry out the killing 17 days later.
